Returns and Complaints

Right of Withdrawal

If:

A) you are a consumer
or
B) you are a natural person, and the contract you have concluded with us after December 31, 2020, is directly related to your business activity, but is not of a professional nature for you,
– in principle, you have the right to withdraw from a distance contract.

You can withdraw from the contract by submitting a statement of withdrawal, for example by sending an email to: sklep@poptime.pl

Please return the item to us without undue delay to the following address:
POP Time Sp. z o.o., ul. Konarowa 5, 03-684 Warsaw,
but no later than 14 days from the date you withdraw from the contract.

You may withdraw from the contract within 14 days.

The fourteen-day withdrawal period begins:

  • for a contract in which we deliver goods and are obliged to transfer their ownership – from the moment you or a third party indicated by you, other than the carrier, takes possession of the goods; in the case of a contract covering multiple goods delivered separately, in batches or in parts – from the moment you or a third party indicated by you, other than the carrier, takes possession of the last good, batch, or part;

  • for digital content – from the date the contract is concluded.

To meet the deadline, it is sufficient to send your statement before it expires.

All payments you have made, including delivery costs as specified in the Terms and Conditions, will be refunded to you promptly and no later than 14 days from the day we receive your withdrawal statement.

We may withhold the refund until we receive the returned item or proof of its return, whichever occurs first.

Please note that the right of withdrawal from a distance contract does not apply, among others, to contracts:

  • for non-prefabricated goods, manufactured according to your specifications or serving to satisfy your individual needs;

  • for perishable goods or goods with a short shelf life;

  • for goods delivered in sealed packaging which, once opened, cannot be returned for health protection or hygiene reasons, if the packaging has been opened after delivery;

  • for audio or video recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery;

  • for the supply of digital content not recorded on a tangible medium, if the performance has begun with your express consent before the end of the withdrawal period and after you have been informed about the loss of the right to withdraw.

Complaints

If the goods purchased from us turn out to be defective, you have the right to file a complaint based on statutory warranty. The best way to file a complaint is by email: sklep@poptime.pl or by post to ul. Konarowa 5, 03-684 Warsaw.

If you are not a consumer, our liability towards you is limited, as permitted by law, to the value of your order, within one year from the date of delivery. The following provisions apply to consumers.

Defective goods should be sent to:

Due to the defect, you may request:

  • replacement of the item with a defect-free one,

  • removal of the defect,
    or submit a statement on:

  • price reduction,

  • withdrawal from the contract – in case of a significant defect.

We are liable for defects discovered within two years from the date of delivery – under the terms specified in the Civil Code.

Your complaint will be reviewed (we will respond) within 14 days from the date we receive your complaint.
